These Terms of Use apply to the purchase and use of the Designed to be Made™ Procreate Scale Calculator (“Calculator”), provided by Ethereal House of Jewellery Design (“Ethereal House”, “we”, “us” or “our”).
By purchasing or accessing the Calculator, the user agrees to these Terms of Use.
1. About the Calculator
The Designed to be Made™ Procreate Scale Calculator is a digital tool created for jewellery designers working in Procreate.
It assists users with calculations and reference information relevant to designing jewellery at scale, including converting real-world millimetre measurements into pixel dimensions according to selected DPI and drawing scale.
2. Purchase and access
Access to the Calculator is available for the one-time purchase price displayed at checkout at the time of purchase. This is not a recurring subscription.
Access is linked to the account and email address used to purchase the Calculator.
Users are responsible for maintaining the security of their login details.
3. Individual licence
Purchase grants the customer a personal, non-exclusive, non-transferable licence to access and use the Calculator.
Customers may use calculations generated by the Calculator as part of their own jewellery design and professional design work.
Customers may not:
- share their account or login credentials with another person;
- resell, sublicense or redistribute access to the Calculator;
- copy, reproduce or distribute substantial parts of the Calculator;
- attempt to extract, reproduce or commercially exploit the Calculator’s software or proprietary content;
- circumvent or attempt to circumvent access controls; or
- represent the Calculator or its proprietary educational content as their own product.
4. Intellectual property
The Calculator, its original content, educational material, graphics, branding and associated Designed to be Made™ materials are owned by or licensed to Ethereal House of Jewellery Design and are protected by applicable intellectual property laws.
Purchasing access does not transfer ownership of these materials to the customer.
5. Accuracy and professional use
The Calculator is designed to assist jewellery designers with measurement, scale and Procreate workflow calculations.
Results depend on information entered by the user, including measurements, DPI and selected drawing scale.
Users remain responsible for checking dimensions, scale, print settings and manufacturing specifications before relying on a design for production.
The Calculator does not replace professional manufacturing judgement, CAD verification where required, or consultation with the jeweller, CAD technician, setter, manufacturer or other professional responsible for producing the finished piece.
Nothing in this section limits any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
6. Procreate and third-party services
The Calculator is an independent product of Ethereal House of Jewellery Design.
Unless expressly stated otherwise, Ethereal House of Jewellery Design is not affiliated with, endorsed by or sponsored by the developers or owners of Procreate or other third-party products or services referenced within the Calculator.
Third-party platforms and software may change independently of Ethereal House of Jewellery Design.
7. Availability and updates
Ethereal House of Jewellery Design may maintain, improve, update or modify the Calculator from time to time.
Temporary interruptions may occur because of maintenance, technical issues or third-party services.
Where reasonably possible, we will work to restore access following technical interruptions.
8. Refunds and Australian Consumer Law
Please refer to the Refund Policy.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law.
9. Suspension of access
Access may be suspended or terminated where Ethereal House of Jewellery Design reasonably believes an account is being used fraudulently, access is being unlawfully redistributed, login credentials are being shared in breach of these Terms, access controls are being circumvented, or the Calculator is being deliberately misused.
Where appropriate, the account holder will be contacted before action is taken.
Nothing in this section limits rights or remedies available under Australian Consumer Law.
